Terms of Service
Please read these Terms of Service (“Terms”) carefully before using Croak File. By creating an account or accessing our service, you agree to be bound by these Terms. If you do not agree, do not use the service.
1. Acceptance of Terms
These Terms constitute a legally binding agreement between you and Croak File (“we,” “us,” or “our”) governing your use of mycroakfile.com and any related services (the “Service”). By using the Service you represent that you are at least 18 years old and have the legal capacity to enter into this agreement.
2. Description of Service
Croak File is a digital legacy planning service that allows you to securely store account credentials, documents, photos, and personal messages (“Vault”), designate trusted contacts to receive that information, and configure delivery conditions (such as check-ins or third-party verification) that determine when your Vault is released.
The Service is currently in early access. Features, pricing, and availability may change. We will make reasonable efforts to notify you of significant changes.
3. Account Registration
You must register for an account to use the Service. You agree to:
- Provide accurate and complete information when creating your account
- Keep your login credentials confidential and not share them with others
- Notify us immediately at support@mycroakfile.com if you believe your account has been compromised
You are responsible for all activity that occurs under your account.
4. User Responsibilities
You agree not to use the Service to:
- Store, transmit, or share content that is unlawful, harmful, or violates the rights of others
- Attempt to gain unauthorized access to any part of the Service or another user’s account
- Interfere with or disrupt the integrity or performance of the Service
- Use the Service for any fraudulent or deceptive purpose
- Reverse engineer, decompile, or otherwise attempt to extract source code from the Service
You are solely responsible for the accuracy and legality of the content you store in your Vault.
5. Trusted Contacts and Data Release
You may designate one or more trusted contacts to receive your Vault upon your passing or incapacitation. By designating a trusted contact, you authorize us to share the contents of your Vault with that person when the delivery conditions you have configured are met.
You are responsible for obtaining any necessary consent from your trusted contacts. We are not liable for the actions of trusted contacts after they receive your Vault contents.
We take reasonable steps to verify delivery conditions before releasing Vault data, but we cannot guarantee perfect accuracy in all circumstances. It is your responsibility to keep your delivery settings and trusted contact information up to date.
6. Intellectual Property
The Croak File service, including its design, software, and content (excluding your Vault data), is owned by us and protected by copyright, trademark, and other intellectual property laws.
You retain all ownership rights to the content you store in your Vault. By using the Service, you grant us a limited license to store, process, and transmit your Vault data solely as necessary to provide the Service.
7. Disclaimers and Limitation of Liability
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or uninterrupted availability.
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of access to your Vault, or failure to deliver your Vault to your trusted contacts.
Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the twelve months preceding the claim, or $100, whichever is greater.
8. Termination
You may close your account at any time by contacting us at support@mycroakfile.com. Upon closure, your Vault data will be permanently deleted within 30 days.
We reserve the right to suspend or terminate your account if you violate these Terms, with or without prior notice. If we terminate your account without cause, we will provide reasonable advance notice and, where applicable, a prorated refund.
9. Changes to Terms
We may update these Terms from time to time. When we do, we will update the “last updated” date and notify you by email. Your continued use of the Service after the effective date of any changes constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and close your account.
10. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws provisions. Any disputes arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
